Conditions of entry
1. Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.
2. Entry is open only to Australian residents. Officers, employees and contractors (and their immediate families) of the Promoter or the agencies or companies associated with this Promotion are ineligible to enter. “Immediate families” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee, officer or contractor.
3. The promotion begins on 21/04/2008. Entries for each draw close at 11:59pm AEST on the dates set out below and final entries close at 11.59pm AEST on 21/06/2008 (“Promotion Period”). The draws will be conducted at 3 Rider Blvd, Rhodes NSW 2138 at 11:00am AEST on the dates set out in the table below. Winners will be notified in writing and their names and state/territory of residence will be published on www.guthy-renker.com.au and in The Australian on the date set out below.

4. To enter, individuals must visit a participating Proactiv Kiosk* (“Participating Kiosk”), fully complete the official "Proactiv Win an iPod Touch" entry form found at the Participating Kiosk, and submit the form to the promotion entry box located at the Participating Kiosk. Entries from one draw do not rollover into the subsequent draw. 9. The deemed winners must provide all information necessary to enable the Promoter to send the prize to a nominated address. 11. The Promoter’s decision is final and no correspondence will be entered into. 12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to suspend, modify, terminate or cancel the promotion. 13. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority. 14. Except for any implied condition or warranty the exclusion of which from these conditions of entry would contravene any statute or cause any part of these conditions of entry to be void (“Non Excludable Condition”), the Promoter excludes from these conditions of entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax implications; and/or (f) a prize or use of a prize. 15. Prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. 16. Subject to any written directions from a regulatory authority, in the event of a prize not being accepted or claimed within 3 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct a further draw on 20/10/2008 at the same time and location as the original draw to distribute the prize. Any winner will be notified in writing and their name and State/Territory of residence will be published on www.guthy-renker.com.au and in The Australian on 03/11/2008. 17. All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition and providing future marketing and promotional material to entrants. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants. 5. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant's identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Incomplete, indecipherable or illegible entries will be deemed invalid.
7. Multiple entries are not permitted, only one entry accepted per person.
8. The first valid entry drawn in each draw from all Participating Kiosks’ entry boxes combined, will each win one iPod Touch valued at $399. Total prize pool value is $798.00.
